Phòng Thương mại và Công nghiệp Việt Nam (VCCI) vừa có văn bản gửi Vụ Pháp chế, Bộ Kế hoạch và Đầu tư, kiến nghị sửa đổi Danh mục ngành nghề đầu tư, kinh doanh có điều kiện tại Luật đầu tư (sửa đổi) năm 2016.

Theo đó, VCCI đã tiến hành rà soát 243 ngành nghề đầu tư kinh doanh và nhận thấy 22 ngành nghề kinh doanh cần được xem xét để bãi bỏ ra khỏi danh mục này. Trong số đó có kinh doanh dịch vụ quản lý, vận hành nhà chung cư (Mục 119).

Xét về bản chất thì đây là hợp đồng việc về dịch vụ, dịch vụ tốt hay không sẽ do thị trường quyết định.

Trong khi đó, theo quy định hiện hành, tại khoản 2, điều 105 của Luật Nhà ở 2014 thì đơn vị quản lý vận hành nhà chung cư phải có đủ điều kiện về chức năng và năng lực theo quy định: Được thành lập, hoạt động theo quy định của Luật Doanh nghiệp hoặc Luật Hợp tác xã và có chức năng quản lý vận hành nhà chung cư.

Bên cạnh đó, đơn vị này phải có các bộ phận chuyên môn nghiệp vụ về quản lý vận hành nhà chung cư bao gồm bộ phận kỹ thuật, dịch vụ, bảo vệ an ninh, vệ sinh, môi trường.

Đồng thời, đơn vị quản lý vận hành nhà chung cư phải có đội ngũ cán bộ, nhân viên đáp ứng yêu cầu về quản lý vận hành nhà ở bao gồm lĩnh vực xây dựng, kỹ thuật điện, nước, phòng cháy, chữa cháy, vận hành trang thiết bị gắn với nhà chung cư và có giấy chứng nhận đã được đào tạo, bồi dưỡng kiến thức chuyên môn nghiệp vụ về quản lý vận hành nhà chung cư theo quy định của Bộ Xây dựng.
