Sở hữu nhà tại thành phố là ước mơ của nhiều người, nhưng vì thiếu kiến thức và kinh nghiệm trong việc giao dịch đã khiến không ít người rơi vào bẫy lừa, mất số tiền lớn tích góp trong nhiều năm.
Mua phải đất quy hoạch công viên, đường giao thông
Từ tỉnh lẻ lên TP.HCM thuê nhà trọ đi làm, sau thời gian tích góp được một số tiền, vợ chồng chị T. (quê Vĩnh Long) có ý định vay thêm ngân hàng để mua căn nhà an cư. Qua cò đất, chị T. được giới thiệu một thửa đất ở xã Phong Phú, huyện Bình Chánh.
Cũng như nhiều người lần đầu đi mua đất, chị T. đến UBND xã kiểm tra quy hoạch thửa đất thì được in cho một bản đồ quy hoạch. Không phát hiện thửa đất có vấn đề gì, chị T. gặp chủ đất để thương lượng giá và đặt cọc 100 triệu đồng.
Trong thời gian chờ công chứng sang tên, chị T. liên hệ với nhà thầu xây dựng để tính toán chi phí xây nhà thì bất ngờ đơn vị này cho biết thửa đất chị mua bị vướng quy hoạch đất công viên cây xanh và đường đô thị. Biết bị lừa, chị T. xin lại tiền cọc nhưng chủ đất không cho.
Cũng không có kinh nghiệm mua nhà đất, chị N. (quê Bình Định) đã bỏ ra 2,2 tỷ đồng mua căn nhà cấp 4 rộng 42,8m2 tại xã Xuân Thới Nhì, huyện Hóc Môn nhưng diện tích được công nhận chỉ 18m2.
Theo chị N., trước khi quyết định mua chị đi xem thực tế thấy những nhà xung quanh đều xây dựng kiên cố nên yên tâm khu vực này quy hoạch là đất ở. Tuy nhiên, sau khi mua thì chị N. mới phát hiện thửa đất của mình có 24,8m2 không được công nhận. Đáng nói, diện tích 9,5m2 của căn nhà cũng không phù hợp quy hoạch.
Cẩn thận kiểm tra quy hoạch thửa đất muốn mua là việc làm cần thiết, thế nhưng vẫn có trường hợp mua nhầm. Mới đây, anh Q. được giới thiệu mua một thửa đất ở quận Thủ Đức với giá chỉ 35 triệu đồng/m2, đây là mức giá rẻ hơn nhiều so với giá bán tại khu vực.
Qua tìm hiểu, thửa đất anh Q. muốn mua không vướng quy hoạch, chứng chỉ quy hoạch của UBND quận được chủ đất cung cấp thể hiện đây là đất quy hoạch xây dựng nhà biệt thự đơn lập, diện tích xây dựng hơn 95%.
Yên tâm giao dịch nhưng sau đó anh Q. tìm hiểu thì biết được chứng chỉ quy hoạch chủ đất cung cấp từ tháng 5/2019. Theo bản đồ quy hoạch trực tuyến của Sở Quy hoạch – Kiến trúc TP.HCM, thửa đất này không còn nằm trong quy hoạch đất ở, đã được chuyển đổi thành đất giáo dục.
